Shaan’xi Taking the Lead in Promulgating Regulations on Modern Agricultural Park

Land for food production earmarked as permanent farmland
Engage farmers in park building, operation and interest sharing
No forceful land transfer against the will of farmers
On July 30th, Shaanxi Provincial Regulations on Modern Agricultural Park was promulgated during the 21st meeting of the 12th Standing Committee of the Provincial People’s Congress. The regulation is an innovative legislation created by our province and the first local legal document to standardize and promote modern agricultural park development in China. The regulation is to come into force on January 1st, 2016.
The regulation requires that the modern agricultural park owners shall provide certificates of business registration or legal entities. Land shall be concentrated and reach a certain scale with clarified ownership. Land transfer contract for ownership shall be standardized with a complete set of trusteeship and registration procedures.
Land for food production is earmarked as permanent farmland. The regulation clarifies the responsibilities of municipal and county level governments in ensuring local food security. Food-producing land should be allocated as permanent farmland and strictly protected by law.
Farmers are encouraged to participate in rural specialized cooperatives or enterprises by way of land or capital contribution and engaged in modern agricultural park building, operation and interest sharing. State-owned farmland, research institutions, vocational training schools and academic research staff are encouraged to take part by way of contributing research outcomes. Businesses are encouraged to invest in modern farming, agricultural products processing and logistics, agricultural modern service, and resource development of modern agricultural parks suitable for commercialized management.
Any business unit or individual shall not force land transfer against farmers’ will and any forced land transfer are deemed as invalid. Other things being equal, farmers who transfer land enjoy priority in employment in modern agricultural park.
Meanwhile, in order to lower market risk for agricultural product exchanges, the regulation encourage and support agricultural park operators and other social groups to set up direct distribution centers and connected supermarkets to increase sales outlets and launch marketing campaigns such as logistics delivery, e-commerce, futures contraction, auctioning etc. to promote sales of agricultural products.
